Safe Use of Long-Acting Opioids – The Legal Perspective

Target Audience

This activity is intended to educate primary care and specialist providers who treat patients with chronic pain.

Program Overview

This session is the final in a four part series on managing chronic pain with extended release and long-acting opioids. 

Attorney Jennifer Bolen is joined by Dr. Bill McCarberg in a discussion of the legal aspects of treating patients with chronic pain. The duo will share insights in how to find the balance in managing risk and providing appropriate pain management. They will also discuss best practices in legal language documentation and informed consent.

Learning Objectives

Upon completion of this activity, participants should be better able to:

  1. Know how to counsel patients and caregivers about the safe use of ER/LA opioid analgesics, including proper storage and disposal.
  2. Recognize and discuss the regulatory, statutory and legal issues that complicate prescribing opioid analgesics.

Jen Bolen, JD

Ms. Bolen has nearly 25 years cumulative experience and training as an attorney and regulatory compliance consultant in pain management and clinical drug testing laboratories, with 10+ years specifically as a nationally recognized expert in the pain and clinical drug testing industry and nearly 14 years as an Assistant US Attorney with the US Department of Justice.

Ms. Bolen regularly conducts practice audits and teaches providers how to perform self-audits with the intent of improving pain management documentation practices and patient relationships. She specializes in the creation and implementation of regulatory compliance programs and patient risk management protocols, including Physician Office Laboratories and Independent. She also specializes in laboratory coding, reimbursement, and fraud and abuse compliance issues. Ms. Bolen has served as a testifying expert witness on pain management law and compliance in federal and state court.

Bill H. McCarberg, MD

Bill McCarberg MD is Founder of the Chronic Pain Management Program for Kaiser Permanente (retired) in San Diego, California. He is currently working as a primary care physician with Neighborhood Healthcare and hospice provider in Escondido California.

Dr. McCarberg is president-elect of the American Academy of Pain Medicine. He is president of the Western Pain Society and Adjunct Assistant Clinical Professor at the University of California at San Diego School Medicine. Dr McCarberg is a member of the American Academy of Family Physicians, the American Pain Society, and the International Association for the Study of Pain. He is the recipient of several awards including the Shilling Compassionate Care Award, the Elizabeth Narcessian award for leader in the field of pain education from the American Pain Society and in 2008 was Ambassador of the Year for the National Pain Foundation. Member Appraisal of Physician Services at Kaiser Permanente rated Dr. McCarberg in the top 10% from 1998-2011.

Dr. McCarberg has given more than 250 presentations on pain management issues and is the author or co-author of 115 articles, book chapters and books. He is board certified by the American College of Pain Medicine, the American Board of Family Practice and additionally certified in Geriatrics. Dr McCarberg received his MD degree from Northwestern University Medical School in Chicago, Illinois. He completed a medical internship and a residency in family practice at Highland Hospital in Rochester, New York.

This activity is comprised of 4 sessions.  Each session will take approximately 60 minutes to complete.  To receive credit, participants are required to complete the pre-test, view the online video and complete the post-test and evaluation form.  To receive credit, a minimum score of 70% must be achieved on the post-test.  A certificate will be immediately available.  There is no fee to participate in the activity or for the generation of a certificate.
